Law Department
The Township Attorney is the chief law officer of the Township and attorney of record in all proceedings. Upon request from the Mayor and Township Council , the Township Attorney provides legal advice on all matters related to local government operation and serves as general counsel to all Department and Division heads on an as needed basis. The nature of the legal matters handled by the Law Department include labor negotiations, municipal tax appeals, contract and legal document preparation, preparation of ordinances and resolutions, attendance at all Council meetings, handling of all Superior Court actions pertaining to the exercise of local government power and such other matters as are assigned by the Mayor, Council, and Department and Division Heads.
All public documents generated by the Law Department are on file with the Municipal Clerk and various other Township Departments and may be viewed in the Marlboro Township Hall, 1979 Township Drive. These documents include all contracts, deeds, ordinances and resolutions of the municipality.
Within the Department of Law is the Municipal Prosecutor. The Municipal Prosecutor is an attorney at law of New Jersey and is appointed by the Mayor with the advice and consent of the Township Council. The Municipal Prosecutor acts on behalf of the state, the complaining witness and the Township in the following instances:
- In all cases involving crimes of violence which are indictable
- In all cases of death by automobile
- In all cases of drunk driving
- In all cases involving assault of a police officer
- In all Zoning Ordinance violations where for any reason the counsel to the Board of Adjustment does not appear
- In special cases at the express instance and written request of the Judge, the Mayor, or Township Council
